The Swisstastic brand is operated by the company Swisstastic Sàrl (hereinafter “the Company”), whose registered office is located at Rue Auguste-Bachelin 1A, 2074 Marin-Epagnier (Neuchâtel), Switzerland. These General Conditions govern the relationship between you as a customer and the Company.

These Terms and Conditions apply to your use of the products and services provided by the Company, including its website (including all information, tools and services available from it), its products and its communications. Your acceptance of all the terms, conditions, policies and notices stated here is required to use our products and services.

By visiting our website and/or making a purchase, you agree to be bound by the following terms and conditions. We encourage you to read these Terms and Conditions carefully before using our website or purchasing our products and services. By accessing or using any part of our website, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, please exit our site and do not use our products and services.

We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. The trademarks "Swisstastic" and "swisstastic.ch" are reserved. Any use of these trademarks and/or the logo is subject to the prior written consent of the Company, which is the exclusive owner.

The use of our products for illegal or unauthorized purposes is strictly prohibited. The Company authorizes the user to consult the swisstastic.ch website only for strictly private purposes. The reproduction, presentation or distribution of the content of this site for commercial purposes is prohibited. This site and its content are protected and any unauthorized use is illegal, resulting in the immediate destruction of all copies, reproductions, downloads or prints.

 

Limitation of Liability

The swisstastic.ch website is normally accessible 24 hours a day, 7 days a week. However, the Company cannot be held responsible for any interruptions to the site and associated services. By using this site, you acknowledge that its content may contain errors and may not be constantly updated. The swisstastic.ch website is provided “as is” and “as available”, without any warranty.

The Company reserves the right to suspend its activities, to temporarily or permanently close the site or access to certain services, without notice or compensation. Under no circumstances can the Company be held responsible for disruptions or the impossibility of using the site, nor for breaches of computer security that may cause damage to users and their data.

 

Products and Services

Swisstastic scratch posters are posters covered with a scratch-off layer. They are wrapped in protective fabric and shipped in a protective cardboard tube via the Swiss Post delivery service.

Until the time of payment, your order can be modified at any time by accessing your customer area on www.swisstastic.ch or by contacting our customer service.

​Registration and account management

To purchase a product on swisstastic.ch, you must follow the indicated purchasing procedure. Registering on swisstastic.ch allows you to create a customer account with your email address and manage your customer data there. To access your customer area, you must indicate the email address used when you registered on the "My Account" page. You will receive an email containing a link valid for 24 hours to access your customer area. If you have difficulties accessing your customer area, you can also send your subscription change requests by email to admin@swisstastic.ch.

You are responsible for all purchases made from your customer area (account), as well as all actions and changes made to your account (change of contact information, payment methods, delivery instructions, etc.). The processing of personal information is governed by our Privacy Policy. You must be at least 18 years old on the date of your registration and not be under guardianship or curatorship.

You are not permitted to use the Site for any illegal purpose or in any way that could damage our business or reputation. We reserve the right to suspend or terminate your access to the Site and/or your account (including associated orders) for non-compliance with these Terms and Conditions. If you suspect or know that a third party has accessed your account without authorization, you must promptly inform Swisstastic customer service (admin@swisstastic.ch).

 

Orders

To place an order, you must follow these steps:

Choose the product(s) you wish to purchase on the Shop page

Validate your basket by clicking on “Payment”

Provide the personal information necessary for delivery of the product(s).

Choose the payment method and proceed to pay for the order

The order confirmation establishes a distance selling contract between the Company and the customer. An e-mail confirmation, issued by swisstastic.ch, will be sent to the customer.

The customer is required to provide the information required to place his order accurately, completely and accurately (full name, address, etc.). Any error in entering this information is the customer's responsibility. Bank card information must be entered completely, accurately and validly. Pricing policy

All prices of products offered for sale on the swisstastic.ch website are indicated in Swiss Francs (CHF). The prices in force are those indicated at the time of the order. The Company is not subject to Value Added Tax, which is therefore not applicable. The prices of the products do not include the price of delivery, which is indicated in addition to the price of the products in the basket summary. The products can be sold separately from the delivery service, by choosing the "collection from the workshop" option, which requires the customer to contact the Company to coordinate the day and time at which the customer wishes to collect their purchases. The address of the workshop is indicated during the purchase process. The prices displayed at the time of payment are authentic.

Swisstastic reserves the right to:

Modify prices at any time, while committing to applying the rates in effect at the time the order is registered, subject to the availability of the products on that date.

Suspend all order management and delivery in the event of refusal of authorization of payment by bank card by officially accredited organizations, or in the event of non-payment.

Refuse to deliver an order from a consumer who has not paid for an order in full.

 

Billing Information

You agree to provide current, complete and accurate purchase and account information for all purchases made at www.swisstastic.ch. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

Payment

Payment for products is made using the payment methods offered during the ordering process, and under the conditions specified therein. We reserve the right to exclude certain payment methods based on the result of the verification of your data (identity and solvency verification).

In order to ensure the security of transactions, all payments by credit card on swisstastic.ch are made via the secure online payment system "Wix Payments", which encrypts all data relating to the order (including names, addresses and credit card numbers), thus guaranteeing the protection of information during transmission.

 

Delivery terms

Swisstastic ensures the delivery of its orders in Switzerland via the company Post CH AG. The products are delivered to the delivery address indicated by the customer when ordering.

The delivery conditions and options (drop-off in case of absence, hold at the counter, delivery to another address, etc.) are managed entirely by Post CH AG. It is the customer's responsibility to communicate their delivery preferences to Post CH AG via the Post CH AG website (poste.ch).

If a product is exceptionally lost, the customer can contact the after-sales service at admin@swisstastic.ch to request a replacement. The decision to make a commercial gesture will be taken unilaterally by the Company.

If a product is returned to the Company by Post CH AG due to a customer error (unclaimed parcel, invalid address, etc.), Swisstastic will keep the returned parcel. It is the customer's responsibility to contact Swisstastic to arrange a new shipment once the cause of the return has been resolved. In this situation, the cost of returning the parcel amounts to CHF 20.-, all taxes included, and is invoiced by Swisstastic. Swisstastic may unilaterally decide to grant a commercial gesture regarding these costs.

 

Product compliance

It is the customer's responsibility to check the conformity of the products received. The verification is considered to have been carried out if no complaint has been made to our customer service within 3 working days after receipt of the package (in case of doubt about the delivery date, the postal tracking is valid).

In the event of an anomaly, such as a broken container leading to the loss or destruction of the contents, an insufficient quantity of goods or non-conformity with the order, the customer must imperatively inform Swisstastic customer service of this non-conformity by submitting a complaint by e-mail within 3 working days following receipt of the goods. Any complaint made after this deadline will not be accepted.

 

Returns and Refunds

It is not possible to return Swisstastic products once the order has been shipped.

Products whose intrinsic qualities do not correspond to the customer's expectations, as well as products ordered in error, are not refundable and therefore cannot be the subject of a claim for non-conformity.

Products recognized as non-compliant with the customer's order will be replaced by Swisstastic within a maximum of 28 working days.

 

Promotional offers

Promotional offers are limited in time. The discounts or benefits associated with them are available for a specific period. They cannot be applied retroactively and do not give rise to any compensation or exchange, whether monetary or otherwise.

The Company reserves the right to suspend or cancel any special offer, even if ongoing, without notice, concerning all promotional operations of the Swisstastic brand. We may, at our sole discretion, limit the number of people who can benefit from an offer for any reason whatsoever.

Your participation in a Swisstastic promotional operation, whether by using a gift voucher, a discount code or via a competition, automatically implies your acceptance of these General Conditions and the specific conditions linked to the promotional operation, if applicable, which will be communicated when the promotional operation concerned is launched.

 

Validity and legal jurisdiction

These General Conditions are subject to Swiss law.

In the event of a dispute relating to these General Conditions, their interpretation and their consequences, or to acts supplementing or modifying them, the parties will endeavour to find an amicable solution before bringing the matter before the courts. The legal venue is Neuchâtel, Switzerland.
